As with any on line store it is always a good idea to spell out what your guarantees are and how we operate our on-line business, so here they are then!

Customer Ordering, Payment, Shipping & Returns

Ordering Products

By placing an order on this website you agree to and accept the terms and price specified in this web site. This price may include delivery and other applicable charges which are stated at the ordering stage.
 
There may be occasions where we have to decline orders for any reason, including, the unavailability of any product, an error in the price or the product description or image posted on this web site, or an error in your order.
 
If Top Catch On-line is unable to source the particular product you require, we will contact you, and inform you of the general date of availability or of alternative products, or offer to cancel the sale.
 
Your contract with Top Catch On-line will only come into existence when you have fully paid for your order and Top Catch On-line provides confirmation that your order has been accepted. Confirmation will be sent via email to your nominated email address.
 
By creating an account with Top Catch On-line you consent to receiving electronic communications from Top Catch On-line. These communications may include: account status updates, order status updates and other information relating to the service. We know how sensitive this information is so here is our Privacy position: 
 
Top Catch On-line understands and empathizes with Internet/Email users personal privacy concerns. We would like to state our policy:  

  • Under no circumstances will we sell, rent or give your private information including name, address, email to third parties.
  • We collect name and address information solely for the purpose of the delivery of goods. 
  • Occasionally we email previous customers special discount offers which we think they may be interested in. On each of these communications, we provide a means by which the recipient may choose to unsubscribe from these emails.
  • Individual users are not identified in Website statistics. These statistics are used to improve the site and monitor traffic.

Stock Availability

In order to provide the greatest range of products, you understand that Top Catch On-line does not stock all products listed on this site in a single warehouse. Also goods delivered may sometimes have cosmetic differences to the product images presented on this site, rest assured we would only send out as good or better products in these circumstances. 

Delivery Estimates

Top Catch On-line makes every effort practical to ensure that delivery timeframes are prompt but we won’t accept liability for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the estimated time frame.
 
If however, dispatch of goods has not happened after 14 days from the order date, you may, elect to treat the failure to deliver as a termination of the contract between Top Catch On-line and yourself. In such an event Top Catch On-line will refund any payment made to it in respect of that particular order if due. 

Payment

Top Catch On-line accepts payment via credit cards or direct bank transfer.
 
Purchases via direct bank transfer are to be made as follows:

You must include the order number as a reference on your bank transfer so we know which order the payment refers to.
 
Incorrect Bank Account Number

Top Catch On-line gives the customer the choice to pay for products through bank transfer. If the Customer credits money to the incorrect bank account number then Top Catch On-line will not accept any responsibility for correcting payment and the goods will not be dispatched.

Pricing

All prices are in New Zealand dollars (NZ$) and include GST (12.5% sales tax). All prices are correct at time of publication; however we reserve the right to alter prices for any reason. If this should happen after you have ordered a product, we will contact you prior to processing your order.

Terms and Conditions of Sale

By accessing, browsing or purchasing using this site, you acknowledge and agree to our terms, conditions and any relevant disclaimers.
 
Top Catch On-line reserves the right to change any or all of the information contained in these terms or conditions at any time. Top Catch On-line reserves the right to refuse service, terminate accounts, remove or edit content or cancel orders at their sole discretion. Any orders cancelled by Top Catch On-line, but paid for, will receive a full refund. Other refunds will be given at the discretion of company management.

Shipping

Delivery Costs

We try to keep out delivery costs to a minimum and reserve the right to amend our rates from time to time. Delivery is charged on a per parcel basis and we will always try to ensure the lowest cost is incurred. Top Catch charges a low flat delivery fee of $4.99 that covers an insured courier delivery almost anywhere in mainland New Zealand. In most instances this cost is heavily subsidised, reasonably if you are living on one of our islands for example in the Hauraki Gulf or live at a Rural Delivery (RD) addess there are addtional costs charged by courier companies above the standard delivey cost  that we need to pass on.

Addtionally for some large or bulky items such as Chilly Bins, Inflatable Boats and some dive gear an additional shipping charge may apply. This charge is is outlined in the product descriptions or order processing section of the site.

If you live locally you are welcome to pick your order up once we have processed it. We will email you that it is ready and available at Top Catch Otahuhu, 25 Princes Street Otahuhu. For a map of the location click here

Delivery Time Frames

In order to provide you with a wide variety of choice, we source product from a number of different of suppliers. Depending on their location, ordered goods are delivered to you within different time frames. While in many cases goods will be dispatched on the same day we receive the order you need to allow a reasonable delivery window should we need to get the goods or part of your order in or you live at a Rural Delivery address.
 
2-4 days
This normally means that Top Catch On-line holds stock at our premise and we ship the same day that your order is received (within Courier pick-up hours of 7 am - 5 pm)
 
4-7 days
The product normally arrives at your home/office within 3-7 days as it is sourced from a distributor in New Zealand.
 

Delivery Risk

Top Catch On-line will retain ownership of the products you order until you have made payment in full for those products. Ownership of those products & the risk in the products will pass to you on dispatch from Top Catch On-line.
 
If a product is found to be mis-addressed by Top Catch On-line then Top Catch On-line shall be responsible for the re-delivery, replacement or refunding of the product. If the Customer is found to have given an incorrect or insufficient address, then Top Catch On-line will not refund or resend the product and all responsibility for correcting delivery will be borne by the Customer. 

Delivery Process

Couriered deliveries will require a proof of delivery signature. Our Couriers will not leave goods at an unattended address unless you request this when placing your order. In this circumstance neither Top Catch On-line not the courier company can be liable for loss of the shipment.
 
If you are not at the specified address when the courier calls a delivery card will be left advising you where the delivery can be uplifted.
 

Insurance

Couriered goods are insured buy our courier companies but they have strict criteria for claims.  Freighted/couriered items must be thoroughly checked inside before signing for your delivery.

Damaged goods: If the couriered goods are found to be damaged in transit please advise us immediately as you have a 15 day window to make a claim.
 
Lost Goods: If the goods fail to arrive please advise us as you have a 30 day window to make a claim.

Returns Policy
Defective Goods:
Firstly you have rights the Consumer Guarantees Act 1993. It states that any goods purchased for personal use may be returned if they are not of an "acceptable quality" (for example, if they are not fit for the purpose for which they are bought, or if they are unsafe).
 
So if you returns goods within the terms of this provision, Top Catch On-line will happily provide a refund or a replacement product within a reasonable period of time at our expense.
 
General Returns: Aside from the Consumer Guarantees Act provisions if you are not completely satisfied with any product that is purchased from Top Catch On-line, for whatever reason, the item with the exception of some listed below may be returned, prepaid, within 30 days of purchase.
 
We do charge a 10% restocking fee to help cover the cost of packaging and time involved in initial packing and subsequent unpacking, and inspection of returned goods. As we also subsidise the shipping cost (substantially on some orders), shipping charges are non-refundable & we will deduct the full amount of shipping costs that has actually been paid by us to ship your product initially.
 
Not unreasonably returns are not accepted on used items, items that are not in original condition, packaging, books, videos, software, or cut lengths of line, rigging, netting etc. Some special order items may not be refundable for example if it was made or ordered specifically to your requirements like a rod.
